Chapter 5 - The Bail HearingTwo weeks later, the formal bail hearing for Mateo and Elena Cruz was held at the downtown criminal justice center.

The story of the "Texas Porch Torture" had captured national news headlines. Outside the courthouse, camera crews and dozens of women's rights advocates held signs reading #JusticeForMaria and #ProtectPregnantWomen.

I sat in the front row of the courtroom beside Rachel Vance and Detective Brooks.

Across the aisle, at the defense table, sat Mateo and Elena. Both were wearing orange county jail jumpsuits, their hands and ankles bound in heavy steel chains. Mateo looked hollowed out—his hair messy, his stubble unkempt, his eyes darting frantically around the room. Elena looked old and withered, her arrogant posture broken by two weeks in a detention cell.

Judge Marcus Vance presided over the bench.

“Your Honor,” Mateo’s defense attorney argued, stepping forward. “My clients are requesting a reduction in bail. Mr. Mateo Cruz is a hardworking laborer with no prior criminal record in this state. The media coverage has sensationalized what was a private marital dispute—”

“A private dispute, counselor?” Judge Vance interrupted, his voice dropping into a cold, dangerous register. “Your client is accused of tying his pregnant wife to a wooden pillar, beating her until she lost her unborn child, and plotting her death for insurance money!”

“Your Honor, the audio recordings are unauthenticated!” the lawyer pleaded desperate.

The prosecutor stepped up to the podium, inserting a flash drive into the courtroom speaker system.

The loud, crystal-clear recording blasted through the chamber:

“She’s screaming too loud, Mateo! Gag her before the neighbors hear!” Elena’s recorded voice shrieked through the speakers.

“She won't scream when I’m done with her!” Mateo’s voice roared back, followed by the sickening thud of a heavy blow and my own agonizing cry.

In the gallery, several news reporters gasped. Two female jurors on the panel covered their mouths in horror.

Mateo slumped forward on the defense table, burying his face in his cuffed hands, shaking uncontrollably.

Judge Vance slammed his gavel down with thunderous force.

“Bail is denied for both defendants,” Judge Vance declared coldly. “You will remain in county custody pending your criminal trial. Remand them to the sheriff!”

As bailiffs dragged Mateo away in chains, he turned his head toward me, his eyes wide with pathetic pleading.

“Maria! Please!” he sobbed out. “I’m sorry! I was wrong! Tell them to let me go! I love you!”

I sat straight in my chair, looking directly past him as if he were nothing more than a ghost.
