Chapter 6 - The Custody Threat

Sarah didn't sleep that night. She sat awake in Lily's doorway long after her daughter had drifted off, watching the small, steady rise and fall of her breathing, and thought about the words less stable primary caregiver until they lost all shape and became just sound.

In the morning, she called Denise before her shift even started.

"He's threatening custody," Sarah said, the words coming out faster than she intended. "He and Whitney talked to a lawyer about whether my hours at the hospital make me unfit."

"That's a common tactic," Denise said, unbothered in a way that Sarah found, against all odds, deeply steadying. "It's meant to scare you into a quick settlement on the fraud and property issues so he doesn't have to fight both battles. It rarely works the way they hope, especially once a judge sees the forged documents. Courts do not look kindly on parents who forge their spouse's signature and then pivot to accusing that spouse of instability."

"But it's not nothing."

"No," Denise agreed. "It's not nothing. So we're going to make sure it doesn't work. I want you to start a caregiving log today — every pickup, every appointment, every school event, every night you're the one making dinner and running the bath and reading the bedtime story. Not because you need to prove you're a good mother, Sarah. You already know that. Because a judge who has never met you will need it laid out in black and white, and unlike Ryan, you don't have to forge a single line of it."

Sarah started the log that night, a plain spiral notebook she kept in the kitchen drawer beside Lily's school folder. It felt strange at first, almost humiliating, to document the ordinary rhythm of loving her own child as though it were evidence. But by the end of the first week, something in her had shifted; the notebook wasn't proof for a stranger anymore. It was a record of exactly how full her life with Lily already was, written down and undeniable.

Ryan moved out that Friday, into a corporate apartment near his office — Sarah suspected, though couldn't yet prove, that it was one Whitney had arranged. He picked up Lily for his court-ordered visitation with a strained, overly cheerful energy that made Lily quiet and watchful for hours afterward.

"Is Daddy in trouble?" Lily asked one evening, unprompted, while Sarah braided her hair before bed.

Sarah chose her words carefully, the way Denise had coached her to. "Sometimes grown-ups make mistakes that they have to fix. That doesn't mean he doesn't love you. It just means some things between me and Daddy need to be sorted out by other grown-ups, like lawyers and judges, so everyone's safe and everything's fair."

"Whitney says you work too much," Lily said.

Sarah's hands stilled on the braid for just a moment before she made herself continue. "What do you think?"

Lily considered this with the grave seriousness only a five-year-old can bring to a real question. "I think you always come to my dance recitals. Daddy missed the last one."

Sarah pressed a kiss to the top of her daughter's head so Lily wouldn't see her eyes fill, and wrote the exchange down in the notebook later that night, word for word, because Denise had told her that children's own observations, offered naturally and without prompting, could matter more in a courtroom than almost anything else.

Three weeks later, Denise called with news that made Sarah sit down hard on the edge of her bed.

"The custody evaluator's report came back," Denise said. "It's very favorable. Lily told the evaluator, unprompted, that you're the one who does bedtime, that you never miss her recitals, and that she doesn't know Whitney very well. Combined with the fraud findings and Ryan's own admission letter, I don't think his lawyer is going to push the custody angle much further. I think it was a bluff, Sarah, and I think it just failed."

Sarah exhaled a breath she felt like she'd been holding since the pumpkin patch. "So what happens now?"

"Now," Denise said, "we finish taking back what's yours."
